Sometimes customers are unable to visit our production facility to try on their purchased items. Lux-Form company staff will come to your location
and help you choose the right size of items.

Contact the company manager and arrange the most convenient time for a meeting. The staff member will bring the workwear uniform of the ordered size,
as well as models one size larger and smaller than expected.

You only pay for the items that fit. When ordering custom tailoring, the Lux-Form employee will take measurements from the customer during the visit and
help choose the best options for fabric and fittings. Uniform from the manufacturer means perfect accuracy and always a perfect fit!

Public Offer Agreement
Under this Agreement, one party, the Seller, on the one hand, and any person who accepts the terms of this Public Offer Agreement, the Buyer, on the other hand, hereinafter
collectively referred to as the Parties, have concluded this Public Offer Agreement (hereinafter referred to as the Agreement), addressed to an unlimited number of persons,
which is an official public offer of the Seller to conclude a sale and purchase agreement with Buyers for the Goods, photographs of which are posted in the corresponding section
of the Website https://lux-form.com/.

Sellers who intend to sell Goods through the Website https://lux-form.com/ and Buyers when purchasing Goods, the images of which are posted on the corresponding pages o
f https://lux-form.com/ accept the terms of this Agreement as follows.

GENERAL PROVISIONS

1.1. Contractual relations between the Seller and the Buyer are executed in the form of a Public Offer Agreement. Pressing the "ORDER" button on the corresponding page of
the Website means that the Buyer, regardless of status (individual, legal entity, individual entrepreneur), in accordance with the current international and Ukrainian legislation,
accepts the terms of the Public Offer Agreement, which are indicated below.

1.2. The Public Offer Agreement is public, i.e., according to Articles 633, 641 of the Civil Code of Ukraine, its conditions are the same for all Buyers regardless of status (individual, legal entity, individual entrepreneur). Upon full agreement with this Agreement, the Buyer accepts the conditions and procedure for placing an order, payment, and delivery of the goods by the Seller, responsibility for dishonest Orders, and for non-fulfillment of the conditions of this Agreement.

1.3. This Agreement enters into force from the moment the "ORDER" button is pressed, with which the Buyer gives consent to purchase the Goods available from the Seller and is valid until the Buyer receives the Goods from the Seller and makes full payment.

1.4. To regulate contractual relations under the Agreement, the Parties choose and, if necessary, apply Ukrainian legislation. If an international treaty, the binding nature of which has been agreed upon by the Verkhovna Rada of Ukraine, establishes rules different from those provided by Ukrainian legislation, the rules of the international treaty shall apply.

TERMS AND DEFINITIONS

"Public Offer Agreement" – a public contract, a sample of which is posted on the Website https://lux-form.com/ and whose application is mandatory for all Sellers, containing an offer from the Seller to purchase Goods, the image of which is posted on the Website https://lux-form.com/, addressed to an indefinite number of persons, including Buyers.

"Acceptance" – acceptance by the Buyer of the Seller's offer to purchase Goods, the image of which is posted on the Website https://lux-form.com/, by adding it to the virtual cart and placing the Order.

"Goods" – a trade item (product, model, accessory, components, and related items, any other trade items), for the acquisition of which on the Website https://lux-form.com/, an offer from the Seller is posted.

"Buyer" – any capable individual, legal entity, individual entrepreneur, according to current international and Ukrainian legislation, who visited the Website https://lux-form.com/ and intends to purchase a specific product.

"Seller" – any capable individual, legal entity, individual entrepreneur, according to current international and Ukrainian legislation, who is the owner or distributor of the Goods and intends to sell them using the Website https://lux-form.com/.

"Order" – a properly executed and placed application of the Buyer on the Website https://lux-form.com/ for the purchase of Goods, addressed to the Seller.

"Legislation" – the norms established by Ukrainian or international legislation to regulate contractual relations under the Agreement.

"Significant defect of the Goods" – a defect that makes it impossible or inadmissible to use the Goods according to their intended purpose, has arisen due to the fault of the manufacturer (Seller), and appears again after its elimination for reasons beyond the consumer's control.

SUBJECT OF THE AGREEMENT

3.1. The Seller undertakes, under the terms and in the manner determined by this Agreement, to sell the Goods based on the Order placed by the Buyer on the corresponding page of the Website https://lux-form.com/, and the Buyer undertakes, under the terms and in the manner determined by this Agreement, to buy the Goods and pay for them.

3.2. The Seller guarantees that the Goods are not pledged, are not the subject of a dispute, are not under arrest, and there are no third-party rights to them.

3.3. The Seller and the Buyer confirm that the current Agreement is not a fictitious or fraudulent transaction, or a transaction concluded under pressure or deception.

3.4. The Seller confirms that they have all the necessary permits for conducting business activities regulating the area of legal relations arising and functioning during the execution of this Agreement and also guarantees that they have the right to manufacture and/or sell the goods without any restrictions, in accordance with the requirements of current legislation of Ukraine, and undertakes to be responsible in case of violation of the Buyer's rights during the execution of this Agreement and sale of the Goods.

SELLER'S RIGHTS AND OBLIGATIONS

4.1. The Seller is obliged to:

adhere to the terms of this Agreement;

fulfill Buyer's orders upon receipt of payment from the Buyer;

transfer the Goods to the Buyer according to the selected sample on the corresponding page of the Website https://lux-form.com/, the order placed, and the terms of this Agreement;

check the quality and quantity characteristics of the Goods during their packaging at the warehouse;

inform the Buyer of a possible additional commission when paying for European orders with cards by informing in this agreement.

4.2. The Seller has the right to:

unilaterally suspend the provision of services under this Agreement if the Buyer violates the terms of this Agreement.

or a business entity from among those offering Goods on the Website https://lux-form.com/ under the unified agreed rules set forth in this public offer agreement.

BUYER'S RIGHTS AND OBLIGATIONS

5.1. The Buyer is obliged to:

timely pay for and receive the order under the terms of this Agreement;

review information about the Goods posted on the Website https://lux-form.com/;

when receiving the Goods from the person who delivered them, verify the integrity and completeness of the Goods by inspecting the contents of the packaging. In case of damage or incomplete packaging of the Goods, these should be recorded in an act signed by both the Buyer and the person delivering the Goods.

5.2. The Buyer has the right to:

place an order on the corresponding page of the Website https://lux-form.com/;

demand the Seller to fulfill the terms of this Agreement;

be informed about any additional commission when paying for orders with cards.

ORDER PLACEMENT PROCEDURE

6.1. The Buyer independently places an order on the corresponding page of the Website https://lux-form.com/ by adding Goods to the virtual cart using the "Add to Cart!" button, or by placing an order via email or phone number indicated in the Contacts section of the Website https://lux-form.com/.

6.2. The Order formation period is up to 21 business days from the date of its placement. If the order is placed on a weekend or holiday, the formation period starts from the first business day after the weekend.

PRICE AND PAYMENT PROCEDURE

7.1. The price of each individual Goods is determined by the Seller and indicated on the corresponding page of the Website https://lux-form.com/. The price of the Agreement is determined by summing up the prices of all selected Goods placed in the virtual cart and the delivery cost, which is determined depending on the delivery method in accordance with the terms of section 8 of this Agreement.

7.2. The Order cost may change depending on the price, quantity, or assortment of the Goods.

7.3. The Buyer may pay for the order in the following ways:

1) by bank transfer to the Seller's current account, indicated in the invoice, including via Internet banking (the Buyer pays for the order after receiving the invoice in the amount of 50% or 100% prepayment).

2) cash on delivery upon receipt of the Order at the delivery service branch within Ukraine

3) by credit card

4) by any other method by agreement with the Seller.

Note. When paying for the order with a payment card, the Buyer may be charged an additional commission by the card issuer, particularly when paying for European orders with a card. Pressing the "ORDER" button on the Website https://lux-form.com/ means that the Seller has informed the Buyer about the possibility of an additional commission when paying for orders.

DELIVERY CONDITIONS

8.1. The Buyer receives the Goods via delivery or in person. The procedure for payment and receipt is indicated on the corresponding page of the Website https://lux-form.com/.

8.2. When delivering Goods to other cities in Ukraine or other countries performed by other Delivery Services (hereinafter referred to as Carrier Companies), the Buyer fully and unconditionally agrees with the Cargo Transportation Rules of these Carrier Companies.

8.3. The fact of receiving the Goods and the absence of claims to the quality of the Goods delivered by the Carrier Companies is confirmed by the Buyer with their own signature on the consignment note, declaration of the Carrier Company, or delivery note upon receipt of the Goods. On its side, the Seller guarantees the shipment of the Goods to the Carrier Company in the quantity specified and paid by the Buyer, in completeness according to the specification of these Goods, and in proper (working) condition and quality.

All questions that arise during payment and receipt of the Goods, the Buyer can clarify through the contact details in the Contacts section.

RETURN CONDITIONS

9.1. According to Article 9 of the Law of Ukraine "On Consumer Protection," the Buyer has the right to exchange Goods of proper quality within fourteen days, excluding the day of purchase, unless a longer period is announced by the Seller. The Buyer has the right to exchange the Goods subject to the provisions of the legislation on the grounds and the list of Goods that are not subject to exchange (return).

9.2. If the Buyer intends to return the Goods, such return is carried out under the "Returns" section of the Website, considering the rules and conditions of the carrier or courier operating in Ukraine or another country, according to the place of receipt of the Goods.

9.3. In the case of at least one of the listed defects, the Buyer must record it in an act of arbitrary form. The act must be signed by both the Buyer and the person delivering the Goods or the Seller. If possible, defects should be documented using photo or video recording. Within one (1) day, the Buyer must notify the manager (the Seller's representative responsible for placing the order for the Goods) of the identified defects and agree on the replacement of the Goods.

9.4. The Parties agreed that if the mandatory requirements of this procedure are not met, the Buyer's receipt of the Goods in proper condition is recognized - without any mechanical damage and in full completeness.

LIABILITY OF THE PARTIES AND DISPUTE RESOLUTION

10.1. The Parties are liable for non-fulfillment or improper fulfillment of the terms of this Agreement in the manner provided by this Agreement and current international and Ukrainian legislation.

10.2. In the event of disputes related to the performance of the Parties under this Agreement, except for disputes regarding debt collection from the Buyer, the Parties undertake to resolve them through negotiations, following the claim procedure. The term for consideration of the claim is 7 (seven) calendar days from the date of receipt. No claim procedure is required for disputes related to debt collection from the Buyer.

10.3. All disputes, disagreements, or claims arising out of or in connection with this Agreement, including those relating to its performance, violation, termination, or invalidity, shall be resolved in the appropriate court in accordance with international and Ukrainian substantive and procedural law.

FORCE MAJEURE CIRCUMSTANCES

11.1. The Parties are not liable for failure to fulfill any of their obligations, except for payment obligations, if they prove that such failure was caused by force majeure circumstances, i.e., events or circumstances that are indeed beyond the control of such a party, occurring after the conclusion of this Agreement, of an unpredictable and unavoidable nature.

Force majeure circumstances include, in particular, natural disasters, strikes, fires, floods, explosions, icing, wars (both declared and undeclared), riots, destruction of goods, delays by carriers caused by accidents or adverse weather conditions, dangers and accidents at sea, embargoes, catastrophes, restrictions imposed by government bodies (including allocations, priorities, official requirements, quotas, and price control), if these circumstances directly affected the performance of this Agreement.

11.2. The Party for whom it has become impossible to fulfill the obligations under this Agreement due to the occurrence of force majeure circumstances must immediately inform the other Party in writing about the occurrence of the above circumstances and, within thirty (30) calendar days, provide the other Party with confirmation of the force majeure circumstances. Such confirmation shall be a certificate, certificate, or other appropriate document issued by an authorized state body located at the place of occurrence of force majeure circumstances.

11.3. The time required for the Parties to fulfill their obligations under this Agreement will be extended for any period during which performance was delayed due to the listed circumstances.

11.4. If the failure to fulfill obligations under this Agreement due to force majeure circumstances continues for more than three months, each of the Parties has the right to terminate this Agreement unilaterally by notifying the other party in writing.

Notwithstanding the occurrence of force majeure, before terminating this Agreement due to force majeure circumstances, the Parties shall make final settlements.

OTHER CONDITIONS OF THE AGREEMENT

12.1. Information provided by the Buyer is confidential. Information about the Buyer is used solely for the purpose of fulfilling their Order (sending a message to the seller about the order of the Goods, sending promotional messages, etc.).

12.2. By independently accepting the Agreement or registering on the Website https://lux-form.com/ (filling out the registration form), the Buyer voluntarily agrees to the collection and processing of their personal data for the following purpose: the data that becomes known will be used for commercial purposes, including for processing orders for the purchase of goods, receiving information about the order, sending via telecommunication means of communication (email, mobile communication) promotional and special offers, information about promotions, draws, or any other information about the activities of the Website https://lux-form.com/.

For the purposes specified in this clause, the Buyer may be sent letters, messages, and materials to the Buyer's postal address, email, and SMS messages may be sent, and calls made to the phone number specified in the form.

12.3. The Buyer gives the right to process their personal data, including: placing personal data in databases (without additional notification about this), storing data for life, accumulating, updating, modifying (as necessary). The Seller undertakes to ensure the protection of data from unauthorized access by third parties, not to distribute or transfer data to any third party (except for the transfer of data to related parties, commercial partners, persons authorized by the Seller to carry out direct data processing for the specified purposes, as well as upon mandatory request from a competent state authority).

12.4. In case of unwillingness to receive mailings, the Buyer has the right to contact the Seller by writing an application for refusal to receive promotional materials, sending it to the postal or email address.

12.5. The Seller is not responsible for the content and accuracy of the information provided by the Buyer when placing the order. The Buyer is responsible for the accuracy of the information specified when placing the order.
